HEXA COMPLEX — Terms of Service & End-User License Agreement

By downloading, installing, or playing the Game, or by creating an account, you agree to these Terms. If you do not agree, do not use the Game. If you are under the age of majority where you live, you may use the Game only with the involvement of a parent or guardian who agrees to these Terms on your behalf.

These Terms incorporate our Privacy Policy. Your use of the Game through a store (Apple App Store, Google Play, Steam) is also subject to that store’s terms.

1. License to play

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play the Game for your own non-commercial entertainment on devices you own or control, as permitted by the store you obtained it from. On Steam the Game is a paid product; on mobile it is offered free with optional in-app purchases (§6).

We (and our licensors) retain all rights, title, and interest in the Game itself — its code, art, audio, trademarks, and design. Except for user-created content (§4), nothing here transfers ownership of the Game to you.

2. Accounts

  • An account is optional but required for cloud save, publishing levels, likes, and leaderboards.
  • You must provide accurate information and keep your credentials secure. You are responsible for activity under your account.
  • Display names are public and must follow the content rules in §5 (no offensive language, impersonation, markup/formatting tricks, or invisible characters). We may require you to change a non-compliant name.
  • You may delete your account at any time in Settings → Data → Delete account (see §8 and the Privacy Policy for what is deleted vs. anonymized), or via redribbongames.com/delete-account if you have already uninstalled the Game.

3. Acceptable use

You agree not to:

  • cheat, exploit bugs, manipulate scores or leaderboards, or use bots/automation;
  • reverse-engineer, decompile, or modify the Game except to the extent applicable law expressly permits;
  • disrupt, overload, probe, or attempt to gain unauthorized access to the Game’s servers or other players’ accounts or data;
  • scrape or bulk-collect content or data from the Game;
  • use the Game to break any law or to infringe anyone’s rights.

4. User-generated content (community levels)

The Game lets you create and publish levels that other players can browse and play (“Your Content”).

  • Ownership. You keep whatever ownership rights you have in Your Content.
  • License to us. By publishing, you grant Red Ribbon Games a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt (e.g. format/normalize for display), publish, publicly display, and distribute Your Content within and in connection with the Game and its promotion, and to make it available to other players. This license lasts as long as the content is published and for a reasonable period afterward for backups and moderation records.
  • Your promises. You represent that you created or have the rights to publish Your Content, that it does not infringe or violate anyone’s intellectual-property, privacy, or other rights, and that it complies with §5.
  • After account deletion. If you delete your account, levels you published may remain available to other players in anonymized form (your display name removed and the level no longer attributed to you). If you want a specific published level taken down entirely rather than anonymized, contact us at redribbongamesofficial@gmail.com.
  • No obligation to host. We are not obligated to publish, keep, or store Your Content and may remove it under §5.

5. Content rules & moderation

Your Content, display name, and level names must not contain material that is:

  • unlawful, infringing, or that violates others’ rights;
  • hateful, harassing, or that promotes discrimination or violence;
  • sexually explicit, or otherwise obscene;
  • deceptive, impersonating another person or brand, or designed to spoof/abuse text rendering (e.g. direction-override or invisible characters, or markup tags).

We apply an automated language filter and provide an in-game Report function. We may, at our discretion and without prior notice, review reports, remove or hide content, and warn, suspend, or terminate accounts that violate these Terms. We are not obligated to monitor content but may do so. Because moderation of community content is currently handled manually, removal may not be immediate.

6. Purchases, virtual items, and ads (mobile)

  • The free mobile version shows advertisements. You can purchase Remove Ads to disable them.
  • Purchases are processed by the platform store (Apple/Google), which handles billing and is the merchant of record. Entitlements (such as Remove Ads) are tied to your store account per that store’s rules (including restore-purchases where the store supports it).
  • On Steam, the Game is a one-time premium purchase handled by Steam.
  • Virtual items and entitlements have no monetary value, are not redeemable for cash, and are licensed — not sold — to you. Refunds are governed by the applicable store’s refund policy; we do not separately process payments or refunds. To the extent the law gives you a statutory withdrawal or refund right, that right is unaffected.

7. Availability and changes

We may update, change, suspend, or discontinue the Game or any feature (including online/community features and servers) at any time. Online features depend on third-party services and your connection and may be interrupted. We are not liable for unavailability of online features, though this does not limit any non-excludable statutory rights you have.

8. Termination

You may stop using the Game and delete your account at any time. We may suspend or terminate your access or account if you materially or repeatedly breach these Terms, or as required by law. On termination, the license in §1 ends; §§4 (license to us for already-published content), 5, 9, 10, 11, and 12 survive.

9. Disclaimers

To the maximum extent permitted by law, the Game is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, error-free, or secure, or that community content created by other players is accurate, appropriate, or lawful. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you, and you may have statutory rights that these Terms do not affect.

10. Limitation of liability

To the maximum extent permitted by law, Red Ribbon Games and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, arising out of or relating to the Game. Our total liability for any claim relating to the Game will not exceed the greater of the amount you paid us for the Game in the 12 months before the claim, or EUR 25. Nothing in these Terms limits liability that cannot be limited by law — for example, liability for death or personal injury caused by negligence, for fraud, or under your non-excludable consumer rights.

11. Indemnity

To the extent permitted by law, you agree to indemnify and hold Red Ribbon Games harmless from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your violation of these Terms, or your infringement of any third-party right. This does not apply to the extent the claim arises from our own breach or negligence, and nothing here limits your non-excludable consumer rights.

12. Governing law & disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-laws rules, and the courts of the Netherlands will have jurisdiction — except that this does not deprive you of the protection of the mandatory consumer-protection laws of your country of residence, or of the right to bring proceedings there where the law gives you that right.

If you are an EU consumer, you may also submit a dispute to the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

13. Changes to these Terms

We may update these Terms as the Game evolves. We will post the updated version with a new effective date and, where required, notify you in-app. Material changes take effect after notice; continued use after the effective date means you accept the revised Terms.
